Court System Structure – Essay Sample

Court System Structure – Essay Sample

Generally in Oklahoma, the court system is a unified state court system, which functions behind the administrator-in-chief, known as the Chief Justice of Oklahoma.  The Oklahoma state exemplifies five types of courts functions under the judiciary, which are known as the Courts of limited Jurisdiction, Courts of General Jurisdiction, an Immediate Appellate Court, Special Courts and Courts of Last Resort.  Also, the Oklahoma judiciary controls two independent courts. The two Courts of Last Resort agreement is only existent within Oklahoma and Texas.

However, in Colorado the Colorado Constitute classifies the state’s court structure, and grants the power to the executive branch, the legislative branch and the judicial branch.  The Colorado Constitution also provides for the establishment of state courts that make up the judicial branch of our government.  Both states get their sources of laws from the United States Constitution and the Bill of Rights, however Colorado State has its own constitution, known as Colorado State Constitution.  The Colorado Constitution also provides precise legal rights for all Colorado individuals.  Also, the Colorado Constitution grants the creation of state courts that create the judicial branch of the Colorado government.  These courts participate in a significant role in the state’s system, because it resolves disagreements between individuals, as well as disputes between individuals and the state.

Personally, I believe Colorado has created a structured government system that can benefit the citizens within the states, as well as the court system.  The reason I feel that the Colorado Constitution is beneficial, is because Oklahoma State offers a Court of Immediate Appeal.  This is a process that occurs because the Oklahoma Court doesn’t have the time or resources to listen and make decisions for all cases.  Therefore, the Oklahoma court system frequently appeals the cases and sends them to another court.  I believe this is a process for the states citizens because it is difficult for the individual to receive a decision on their court order.  The Court of Immediate Appeal, granted by Oklahoma State, exemplifies a prolonged matter for each individual.  Whereas in Colorado, the state already has a constitution that the court system strictly follows, therefore the case is sent to a direct court, which maintains unnecessary issues and manners.
